Privacy Policy

This Privacy Policy describes how Magnitude AI Inc. (“Magnitude,” “we,” “us”) collects, uses, and shares information when you use the Magnitude command-line tool, our website at magnitude.dev, our developer console, our API, and related services (together, the “Services”). This Policy is incorporated into our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.

1. Information We Collect

1.1 Information You Provide

Account information. When you create an account, we receive your name, email address, and basic profile information from the third-party authentication provider you use to sign in.

Billing information. When you make a purchase, our payment processor collects your payment method details directly. We receive customer identifiers, transaction records, and your billing preferences. We do not receive or store full payment card numbers.

Communications. If you contact us by email or through other channels, we receive the information you choose to share.

Content you submit through the Services. As you use Magnitude, you submit prompts, messages, and other content to the Services, and the Services process information about your environment (such as files in your working directory) in order to respond. This content is processed as described in Section 3.

1.2 Information We Collect Automatically

Usage and request metadata. When you use the Services, we automatically collect information about your interactions, including the requests you make to our API, the models you use, the volume of your usage, performance metrics, error data, the type of device and operating system you use, and a session identifier. We use this information to operate and improve the Services.

Cookies and similar technologies. Our website and developer console use cookies and similar technologies to operate the Services and understand how they are used. We use two categories of cookies:

  • Essential cookies, which keep you signed in and allow core features of the Services to function. Disabling these may make parts of the Services unavailable.
  • Analytics cookies, which help us understand how users interact with the Services so we can improve them.

We do not use advertising cookies and do not host third-party advertising trackers on our website. Most browsers let you remove or reject cookies through their settings; for more information about cookies and how to manage them, visit www.allaboutcookies.org. Note that if you remove or reject essential cookies, some features of the Services may not work. See Section 7.4 for more on Do Not Track and Global Privacy Control signals.

1.3 Sources of Personal Information

We collect personal information from the following categories of sources:

  • From you, when you create an account, make a purchase, contact us, or submit Content through the Services.
  • Automatically, when you interact with the Services, as described in Section 1.2.
  • From third parties, such as the authentication provider you use to sign in, our payment processor, and analytics providers that help us understand how the Services are used.

1.4 Sensitive Personal Information

We do not intentionally collect sensitive personal information as defined under applicable state privacy laws (such as government identifiers, precise geolocation, financial account credentials, health information, or biometric data), and we ask that you not submit such information to the Services.

2. How We Use Information

We use the information we collect to:

  • provide, maintain, and operate the Services, including authenticating you, processing your requests, and returning responses;
  • bill you for your use of the Services and process payments;
  • understand how the Services are used and to develop, test, and improve them;
  • detect, prevent, and address abuse, fraud, security incidents, and violations of our Terms;
  • communicate with you about your account, security, billing, and material changes to the Services;
  • comply with legal obligations and respond to lawful requests.

We do not sell your personal information. We do not show you targeted advertising or share your data with advertising networks.

3. Content Submitted Through the Services

Because Magnitude is an AI coding agent, you submit content to the Services as part of normal use, including prompts, messages, files the agent reads, and similar material (collectively, your “Content”). The Services process your Content to respond to your requests. We use Content to operate the Services, enforce our Terms, keep the Services secure, and comply with law.

To generate responses, we may transmit your Content to third-party AI model providers we work with. Those providers process your Content in accordance with their own terms and privacy practices. We select providers we believe offer appropriate data protections, but we do not control their practices. See Section 4.

4. How We Share Information

We share information with the following categories of recipients:

  • Service providers. Third parties that help us provide the Services or perform business functions on our behalf, including hosting and infrastructure providers, AI model providers, authentication and database providers, billing and payment processors (such as Stripe, whose privacy policy is at https://stripe.com/privacy), analytics providers (such as PostHog), and customer support tools.
  • Legal and safety. Law enforcement, government authorities, or other parties where we believe in good faith that disclosure is necessary to comply with a law, regulation, subpoena, or legal process; to protect the rights, property, or safety of Magnitude, our users, or others; to enforce our Terms; or to investigate fraud or abuse.
  • Business transfers. Counterparties and their advisors in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets. In such an event, your information may be transferred as part of the transaction.
  • Professional advisors. Lawyers, accountants, auditors, and similar advisors in the course of the services they render to us.
  • With your direction or consent. Other parties when you ask us or authorize us to share information with them.

Our service providers are required by contract to use the information we share only to perform services for us and to protect that information consistent with applicable law.

5. Data Retention

We retain personal information for as long as needed to provide the Services and for the purposes described in this Policy, including to satisfy legal, accounting, or reporting obligations, to resolve disputes, and to enforce our agreements. The specific retention period depends on the type of information and the purpose for which it was collected. When we no longer need information, we delete it or anonymize it. You can ask us to delete your information as described in Section 7.

6. Security

We use reasonable administrative, technical, and physical safeguards designed to protect the personal information we hold from unauthorized access, use, disclosure, alteration, and destruction. No method of transmitting or storing data is perfectly secure, however, and we cannot guarantee the absolute security of your information. You are responsible for keeping your account credentials and API keys confidential and for the security of the devices on which you install or use the Services.

7. Your Choices and Privacy Rights

7.1 Access, Update, and Delete

You can review and update your account information in our developer console. To request deletion of your account or other information we hold about you, contact us at contact@magnitude.dev. We may retain certain information after a deletion request as required by law or to resolve disputes.

7.2 Communications

We may send you transactional emails about your account, security, and billing. We don’t currently send marketing emails; if we do in the future, every marketing email will include an unsubscribe link.

7.3 U.S. State Privacy Rights

Depending on your state of residence, you may have additional rights regarding the personal information we hold about you, including the right to know what we collect, the right to access a copy of that information, the right to correct inaccurate information, the right to delete information, and the right to non-discrimination for exercising these rights. Some states also provide rights to opt out of certain processing, such as the sale of personal information, sharing for targeted advertising, or profiling that produces legal or similarly significant effects. We do not engage in any of those activities.

To exercise any of these rights, contact us at contact@magnitude.dev. We may need to verify your identity before responding, and we may decline a request where permitted by law. If we deny a request, you may appeal by replying to our response. Where your state allows, you may also designate an authorized agent to make a request on your behalf; we may ask the agent for proof of authorization.

California residents may also report concerns under California Civil Code Section 1789.3 to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 N. Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at (800) 952-5210.

7.4 Do Not Track and Global Privacy Control

Our Services do not currently respond to “Do Not Track” browser signals. Because we do not sell personal information or share it for cross-context behavioral advertising, Global Privacy Control (GPC) signals do not change how we handle your data.

8. Children

The Services are not intended for anyone under 18 years old, and we do not knowingly collect personal information from children under 18. If you believe a child under 18 has provided us personal information, please contact us at contact@magnitude.dev and we will take appropriate steps to delete that information.

9. International Users

We are based in the United States, and the Services and our service providers operate in the United States and other countries. If you access the Services from outside the United States, your information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your home country.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post a notice on our website, update the “Effective date” above, and, where appropriate, notify you by email. Your continued use of the Services after the change takes effect means you accept the updated Policy.
